Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Silver Spoon ("we," "us," or "our") governing your access to and use of the Silver Spoon mobile application, this website, and related services (collectively, the "Service"). Please read them carefully. By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority where you live, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements.
2. Account Registration and Security
To access certain features, you must create an account using Apple Sign-In, Google Sign-In, or another supported method. You agree to (a) provide accurate and current information, (b) maintain the security of your login credentials, and (c) be responsible for all activity that occurs under your account. Notify us immediately at silverspoonapp2026@gmail.com if you suspect unauthorized use. We are not liable for any loss resulting from your failure to safeguard your account.
3. Subscriptions and Billing
The Service is offered on a paid subscription basis. Two options are available:
- Monthly subscription at $7.99 per month, including a 7-day free trial for new subscribers
- Annual subscription at $49.99 per year, including a 7-day free trial for new subscribers
Prices are shown in U.S. dollars and may vary by region. All purchases are processed by Apple (App Store) or Google (Play Store) and are subject to their respective terms.
4. Auto-Renewal
Subscriptions automatically renew at the end of each billing period (monthly or yearly, depending on your plan) unless canceled at least 24 hours before the end of the current period. Your payment method will be charged the then-current subscription price at the start of each renewal. You can manage or cancel your subscription at any time in your device's App Store or Play Store account settings. Uninstalling the app or deleting your account does not cancel your subscription.
5. Free Trial
New monthly subscribers may be eligible for a free trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged. You may cancel at any time during the trial at no cost and will retain access until the trial period expires. Free trials are limited to one per user and are not available if you have previously subscribed.
6. Refunds
Except as required by law, all purchases are final and non-refundable. Refund requests are handled by Apple or Google under their respective policies — we cannot issue refunds directly for purchases made through those stores. If you believe you are entitled to a refund, please contact the platform where you made the purchase.
7. Price Changes
We may change subscription prices from time to time. If we increase the price of your subscription, we will notify you in advance and give you an opportunity to cancel before the change takes effect. Continuing your subscription after a price change constitutes acceptance of the new price.
8. License to Use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Service on a device that you own or control, solely for your personal, non-commercial use. You may not sublicense, resell, or redistribute the Service or any of its content.
9. Acceptable Use
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the Service or its content
- Reverse engineer, decompile, or attempt to extract the source code
- Use the Service to violate any law or the rights of others
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service, servers, or networks
- Use automated tools (bots, scrapers) to access or extract content
- Share, transfer, or allow others to use your account credentials
- Use the Service to harass, abuse, or harm others
10. Intellectual Property
The Service and all content within it — including recipes, images, text, graphics, logos, icons, code, and design — are owned by Silver Spoon or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted above, no rights are granted to you. All rights not expressly granted are reserved.
11. Third-Party Services
The Service may integrate with or link to third-party services (e.g., Apple, Google, Firebase, RevenueCat, Spoonacular). Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, content, or practices of any third-party service.
12. Health Disclaimer
Silver Spoon provides recipes and nutritional information for informational and educational purposes only. The content is NOT medical advice and is not intended to diagnose, treat, cure, or prevent any disease or health condition.
Always consult your physician, registered dietitian, or other qualified healthcare provider before making dietary changes, particularly if you have existing health conditions, food allergies, or are pregnant, nursing, or taking medications. Nutritional values are estimates and may vary based on specific ingredients, brands, and preparation methods. You are solely responsible for any decisions you make based on information in the Service.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SILVER SPOON, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR HEALTH OUTCOMES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) USD $50.
15. Indemnification
You agree to defend, indemnify, and hold harmless Silver Spoon and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of another party.
16. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time and cancel your subscription through your App Store or Play Store account. You may also permanently delete your account and associated data at any time in the app under Settings → Delete Account. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
17. Changes to the Service
We may add, modify, or remove features of the Service at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of any part of the Service.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, where appropriate, notify you within the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of your country of residence, without regard to conflict of law principles. Where local law requires, nothing in these Terms limits consumer rights that cannot be waived by contract.
20. Dispute Resolution
Before filing a formal claim, you agree to first contact us at silverspoonapp2026@gmail.com and attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, either party may pursue the claim in a court of competent jurisdiction in the governing law location specified above, unless binding arbitration is required by applicable law. You agree that any dispute will be resolved on an individual basis and not as part of a class action.
21. Apple and Google Specific Terms
If you obtained the Service through the Apple App Store, you acknowledge that these Terms are between you and Silver Spoon only, not Apple, and Apple is not responsible for the Service or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The same applies, where relevant, to Google and the Play Store.
22. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Silver Spoon regarding the Service and supersede any prior agreements.
